Legal Discovery

The volume and variety of electronic information generated in the normal course of business operations significantly increases both the opportunities and risks of discovery.

An organization’s e-discovery plan should consider the full range of electronic information that may need to be required by the courts.  To prepare for the possibility of a discovery order covering electronic records, organizations should consider the following:

Access.  Can electronic records be accurately, quickly and confidently found when requested under litigation or audit?  Can all records, regardless of generating application, be found using the same search method?

Long-term access.  Can electronic records be preserved in such a way that they can be accurately, quickly and confidently found several years from now?

Separation.  Can electronic records required to support a discovery request be viewed separately from records that are not requested at that time?  Can you ensure that you are protected against inadvertent disclosure?

Deletion. Are you confident that you are systematically destroying records that are no longer required?

The AXS-One Compliance Platform™
delivers comprehensive Discovery functionality:

A single, scalable repository for secure archiving of all electronic records, including e-mail and instant messages.  Records are automatically and systematically archived, using rules-based processes, to facilitate future discovery requirements.
Access to all electronic records, from multiple current and legacy systems, utilizing powerful search tools, is available through a single search interface.
The context of archived records is always retained.
Comprehensive corporate file plans with retention and disposition policies for all corporate records, regardless of underlying application
Records are stored in their original format.  A comprehensive and compliant audit trail ensures that all activity is securely logged and can be reproduced with full process chain of control.
A full process chain of custody provides documented evidence of all program events that have interacted with records, from initial acquisition to final destruction, ensuring that the authenticity of records will be considered trustworthy by the courts.
All records relating to a specific action are placed on legal hold, ensuring they cannot be destroyed or modified in any way until the hold order is lifted.
