Now that electronic records like e-mail play an increasing role as evidence in court cases, organizations, no matter what industry they are in, must come to grips with how their electronic records are managed. Failure to provide records under a discovery order can now be used to support a contestant’s punitive claims, as seen recently in the U.S. Perelman vs. Morgan Stanley case, resulting in $1.5 billion in damages.

In theory, organizations not subject to any retention regulations could protect themselves from e-mail discovery orders by instituting a policy to delete all e-mails older than thirty days, but in reality, many e-mails contain business critical information that, if deleted before its value expires, poses an even greater loss to the organization than the risk of a discovery order. Moreover, deleting mail from servers does not prevent copies stored locally or sent out to other organizations from getting in the hands of the opposing party. The same issues of integrity, security, privacy and retention that apply to hard copy records now apply equally to records in electronic form. Like hard copy records, organizations need to ensure all their electronic records are managed according to internal policies and regulations.
