Organizations faced with an electronic discovery order have many questions that need to be addressed as a matter of urgency including:

1. Who knows where the records are located?
2. In the case of e-mail and IM, have all inbound and outbound messages been captured?
3. If records are unavailable is there a justifiable reason why (i.e.- destroyed as a matter of corporate policy)?
4. Are there policies in place for the management of electronic documents? If so were they followed?
5. How does legal counsel access the records?

Unfortunately, for many organizations the answers to these questions are not good. Records may be dispersed across multiple systems, backup tapes and desktops. They could be controlled by different people across departments and business units. A company-wide electronic records management policy may not exist, and if it does, it may not be adequately enforced. Without auditable processes, there is no assurance that all records have been captured and legal counsel has no idea if their opponent has found a smoking gun, and the list goes on. When an electronic discovery order is received, organizations in this situation face significant disruption to day-to-day business activities, incur tremendous discovery costs, risk spoliation, risk violating privacy or confidentiality policies, and risk producing potentially incriminating evidence not subject to the discovery order.

Searches are performed using a web-based ‘wizard’ that guides legal and compliance users through otherwise technically complex tasks. Rather than IT getting involved with the individual requests the wizard allows them to encapsulate query components into English phrases that become available to the end-user at the click of a checkbox.

Rapid-AXS can be used to preview results of the wizard-driven search along with total counts in as little as a few seconds across millions of records. If results are not in line with expectations, the query can be refined and a new preview becomes available in seconds. Once the desired results have been achieved, the actual extraction from tamper-proof storage media and packaging of documents for review or distribution to outside counsel can now take place “off-line” using multiple parallel threads for increased performance. Status of these off-line jobs is immediately available. However, the user does not need to keep their browser open while waiting for results and instead can come back at a later time to pick up the results zipped, or burst into media-sized pieces.
